SECTION 1 - PREAMBLE
These internal regulations have been drawn up in accordance with the provisions of Articles L6352-3 and L6352-4 and R6352-1 to R6352-15 of the French Labor Code.
Its purpose is to lay down measures for applying health and safety regulations, as well as general and permanent rules relating to discipline.
It is intended to apply to all registrants and trainees taking part in the various training courses organized by the ENGIE University training organization registered with the Paris RCS under no. 401 227 988.
Siret 401 227 988 00037, registered under n°11753508775 with the Prefect of the Ile de France region.
It is supplemented and clarified as necessary by memos in accordance with the texts in force.
SECTION 2 - SCOPE OF APPLICATION
The provisions of these rules apply throughout the training center, including the main buildings and outbuildings (training rooms, cafeteria, courtyard, parking lot, etc.). Trainees are required to comply with these regulations without restriction or reservation for the duration of the training course.
Trainees are deemed to have accepted the terms of the internal regulations when they take part in training provided by the training organization. They accept the measures taken against them in the event of non-compliance.
SECTION 3 - HYGIENE AND SAFETY
Article 1 - General
The prevention of accidents and illness is imperative and requires everyone to comply fully with all applicable health and safety regulations. To this end, general and specific safety instructions in force within the organization, where they exist, must be strictly adhered to, failing which disciplinary action may be taken. However, in accordance with article R6352-1 of the French Labor Code, when training takes place in a company or establishment that already has its own internal regulations, the health and safety measures applicable to trainees are those of the latter.
Article 2 - Safety procedures and instructions
All trainees are reminded that they are required to comply with the specific instructions given to them by the teaching staff for the execution of their work, and in particular with the safety instructions specific to this execution.
With the exception of provisions specific to maintenance services, any intervention on protection and safety devices, for whatever reason, is strictly forbidden and constitutes a particularly serious offence.
Article 3 - Fire instructions
In accordance with article R4227-28 et seq. of the French Labor Code, fire instructions, fire extinguisher locations and emergency exits are posted on the training premises, so that all trainees are aware of them.
It is forbidden to handle emergency equipment (extinguishers, hoses, stretchers, etc.) when not in normal use, or to hinder access to them or to emergency exits in any way whatsoever.
Article 4 - Electrical installations
Work on or near electrical installations is strictly reserved for authorized personnel.
Article 5 - Traffic
Trainees are obliged to use only authorized traffic lanes when on the premises of the training organization and its outbuildings.
Article 6- Alcoholic beverages
It is forbidden for trainees to enter or remain in the organization in a state of intoxication, or to bring in alcoholic beverages.
Article 7 - No smoking or vaping
Pursuant to decree no. 2006-1386 of November 15, 2006 and the circular of November 24, 2006, smoking is prohibited on the training premises, except in areas reserved for this purpose. Vaping is also prohibited.
Article 8 - Warning procedure
Any trainee who has reasonable cause to believe that a training situation presents a serious and imminent danger to his or her life or health, must immediately notify the trainer and the building's general resources.
Article 9 - Accidents
Any accident or incident occurring on the occasion of or during training must be reported immediately by the trainee involved in the accident, or by those who witnessed the accident, to the head of the training organization (or within 24 hours at the latest). This is to enable the manager of the training organization to make the legally required declarations within the prescribed deadlines, in accordance with article R.6342-3 of the French Labor Code.
SECTION 4 - DISCIPLINE
Article 10 - General principles
During training, trainees are under the trainer's responsibility, and must therefore comply with the trainer's instructions.
Any act likely to disturb good order and discipline is forbidden. The following in particular are considered as such
-Incorrect behavior towards any person present on the training premises;
*Incivility;
*Bringing in prohibited items (weapons, drugs, etc.);
*Introducing or facilitating the intrusion of strangers;
*Staying or entering the workplace without authorization;
*Leaving training without authorization;
*Dressing indecently;
*Damaging tools or premises of any kind;
*Unauthorized removal of documents or objects belonging to the training organization;
-Inciting acts likely to disturb the harmony of working groups;
-Committing breaches of public decency.
Article 11 - Schedules, absences and lateness
Training schedules are set by the training organization and brought to the attention of trainees by means of invitations sent to their supervisors. Trainees are required to respect training schedules.
The training organization reserves the right, within the limits imposed by the provisions in force, to modify training schedules in line with service requirements. Trainees must comply with any changes made by the training organization to the training schedule. In the event of absence or lateness, trainees must notify the training manager.
In addition, trainees are required to complete and sign the attendance sheet for each half-day of training, and to comply with any formalities required as part of the training program.
Article 12 - Liability for theft or damage to trainees' personal property
The training organization declines all responsibility in the event of loss, theft or damage to personal items of any kind left by trainees on its premises (classrooms, workshops, administrative premises, changing rooms, etc.).
Article 13 - Disciplinary procedure
Nature and scale of sanctions
In accordance with article R6352-3 of the French Labor Code, any measure, other than verbal comments, taken by management or its representative following an action considered by the latter to be at fault, whether or not this measure is likely to affect the trainee's immediate presence in the training program or to jeopardize the continuity of the training received, constitutes a sanction. Fines or other financial penalties are prohibited.
The management reserves the right to apply one of the following sanctions in the event of infringement of the present regulations (or the memos issued for their application) or in the event of misconduct on the part of the trainee (theft, breach of trust, assault, insults to the management or members of staff, trainers, etc.).
*Written warning(s);
*Temporary dismissal, with or without immediate effect, with information to funding bodies and employer;
*Definitive dismissal, termination of the training agreement or contract, with information to funding bodies and employer.
Disciplinary procedure
In accordance with current legislation, the present regulations set out the procedures applicable to disciplinary matters, as set out in articles R6352-4 et seq. of the French Labor Code.
According to the provisions of article R6352-4 of the French Labor Code, "No sanction may be imposed on a trainee without the latter having first been informed of the grievances against him/her".
In this respect, when management is considering imposing a sanction which may or may not have an immediate impact on a trainee's attendance at a training course, it summons the trainee in writing by registered letter or by hand-delivery against receipt. This letter indicates the purpose of the meeting, the date, time and place of the interview, and the trainee's right to be assisted by a person of his or her choice, in particular the course delegate.
The director or his or her representative indicates the reason for the proposed sanction and takes the trainee's explanations.
The sanction is the subject of a written, reasoned decision, notified to the trainee or apprentice by registered letter or delivered against receipt. It may not be applied less than one clear day or more than fifteen days after the interview. (Article R6352-6 of the French Labour Code)
Similarly, when the behavior has made it essential to take a precautionary measure of temporary exclusion with immediate effect, no definitive sanction, relating to this behavior, will be taken without the trainee or apprentice having been informed beforehand of the grievances held against him or her, in accordance with Article R. 6352-4 of the Labor Code and, possibly, without the procedure provided for in Articles R. 6352-5 and R. 6352-6, described above having been observed. (Article R6352-7 of the French Labor Code).
The director of the training organization informs the employer and the funding organization of the sanction taken. (Article R6352-8 of the French Labor Code)
Article 14 - Trainee representation
In accordance with Article L6352-3 of the French Labor Code, for each training course lasting more than 500 hours, a titular delegate and a deputy delegate are elected in a two-round uninominal ballot.
All trainees are eligible to vote, with the exception of inmates admitted to participate in a training program.
Voting takes place during training hours. It takes place no earlier than twenty hours and no later than forty hours after the start of the first collective session.
The director of the training organization is responsible for the organization and smooth running of the ballot. If, at the end of the ballot, it is established that trainees cannot be represented, the director will draw up a statement of default.
Delegates are elected for the duration of the course. Their functions end when they cease, for whatever reason, to take part in training courses.
If the titular delegate or the alternate delegate cease their functions before the end of the training course, a new election is held.
The delegates make all suggestions for improving the course of training and the living conditions of trainees in the training organization.
They present all individual or collective complaints relating to these matters, to health and safety conditions, and to the application of internal regulations.

SECTION 5 - PUBLICATION ENTRY INTO FORCE
The present regulations are posted inside the premises.
A copy is given to each trainee prior to final enrolment, in accordance with the provisions of article L. 6353-8 of the French Labor Code.
